The agreement that governs your use of this website and all sacred offerings by Diana Bomeny.
These Terms of Service ("Terms") govern your use of dianabomeny.com (the "Site") and every sacred offering made available or booked through it, including courses, private sessions, group classes, workshops, ceremonies, retreats, corporate wellness engagements, speaking, and guest facilitation. The Meditation Library is delivered through a separate mobile and web application (the "App") and is governed by the App's own terms of use, in addition to these Terms where a subscription is purchased through the Site. By using the Site or booking any sacred offering, you agree to these Terms. If you do not agree, please do not use the Site.
ABOUT
This Site is owned and operated by Diana Bomeny ("we," "us," "our," or "Diana Bomeny"), based in Miami, Florida, United States, with a healing centre set in Mallorca, Spain. Inquiries may be sent to hello@dianabomeny.com.
ELIGIBILITY
You must be at least 18 years old to create an account, subscribe to the Meditation Library, purchase courses, or book any sacred offering. If you are booking on behalf of someone else, you confirm you have their consent and authority to do so.
YOUR ACCOUNT
Some sacred offerings require an account. You agree to provide accurate information, keep your login credentials private, and notify us promptly if you suspect unauthorized access. You are responsible for activity that occurs under your account. We may suspend or close accounts that violate these Terms or that are used to share access beyond a single person.
SACRED OFFERINGS
Everything offered through this Site is a sacred offering — a teaching, a practice, a space held with intention. Descriptions, schedules, pricing, and availability may change over time. We do our best to keep the Site current and accurate; minor discrepancies do not create a contractual right. Where a specific offering has its own booking terms, cancellation policy, or participant agreement, those terms apply alongside these general Terms.
BOOKINGS AND PAYMENTS
Bookings for private sessions, group classes, workshops, courses, retreats, and other sacred offerings are confirmed once payment (or a required deposit) has been received and a confirmation has been sent to you. Prices are listed in U.S. dollars unless otherwise noted. Payments are processed through secure third-party providers, and by completing a booking you authorize the charge described at checkout.
Applicable taxes, bank fees, or currency conversion charges are your responsibility. If a payment fails or is reversed, we may pause or cancel access to the corresponding offering until payment is resolved.
CANCELLATION AND RESCHEDULING
Private sessions: Rescheduling or cancellation is available with at least 48 hours' notice, at no charge. Within 48 hours, the session fee is retained. No-shows are charged in full.
Group classes and workshops: Cancellations made at least 24 hours before the scheduled start receive a credit toward a future class. Within 24 hours, the class fee is retained.
Courses and digital offerings: Because digital content is delivered immediately and cannot be returned, course purchases are final once access has been granted. If you have not yet accessed any lessons, a refund may be requested within 7 days of purchase by emailing hello@dianabomeny.com.
Retreats: Retreat places are confirmed by application and deposit. The deposit is non-refundable and secures your place. Payment then follows this schedule: 50% of the remaining balance is due 90 days before the retreat start date, and the final balance is due 30 days before the retreat start date. Places are transferable to another person with Diana's prior written approval; transfers are handled case by case and may require a small admin fee. Full terms, including any additional retreat-specific requirements, are provided with the retreat booking agreement you receive on acceptance.
We reserve the right to cancel or reschedule any offering due to illness, travel disruption, low enrollment, or circumstances beyond our control. In that event, you will receive either a full refund for the affected offering or the option to transfer your place to a future date.
MEDITATION LIBRARY SUBSCRIPTION
The Meditation Library is a subscription to an expanding collection of guided meditations, breathwork, and sound, delivered through a separate mobile and web application (the "App"). The Site may promote the Library and direct you to the App, but the Library content itself is accessed only within the App. Use of the App is governed by the App's own terms of use, which you will accept when you create an account there. The following terms apply where a Library subscription is purchased or managed through the Site or through Diana Bomeny directly.
Billing: Your subscription renews automatically at the interval you selected (monthly or annually) until you cancel. You authorize the recurring charge when you subscribe. Subscriptions purchased through the Apple App Store or Google Play Store are billed and managed by those platforms under their own terms.
Cancellation: You may cancel at any time from within the App or the platform where you subscribed. Cancellation takes effect at the end of the current billing cycle, and you retain access until that date. We do not provide partial refunds for unused time within a billing cycle.
Access: Your subscription is for personal, non-commercial use by one person. You may not share your login, redistribute the audio or video files, or use the Library content in your own teaching, classes, or offerings without written permission.
Changes: From time to time we may adjust subscription pricing, features, or Library content. We will notify you of material changes in advance. If a price increase applies to your subscription, you may cancel before it takes effect.
COURSES AND DIGITAL CONTENT
Courses, including The Crystal Pathway mini-courses and Crystal Healing Certification programs, grant you a personal, non-transferable license to access the course materials for your own study. Unless the course description explicitly states otherwise, purchase does not grant:
- The right to teach the course content to others.
- The right to copy, distribute, resell, or publish the lessons, scripts, audio, video, or workbooks.
- The right to use Diana Bomeny's name, likeness, course titles, or certifications in marketing your own services.
Certification status, where offered, is earned on successful completion of the stated requirements and remains subject to the professional standards outlined in the certification agreement.
Crystal Healing Certification — graduate rights: Graduates of Crystal Healing Certification (Level 1 or Level 2) may practise crystal healing under their own name and brand, and may describe themselves as "Certified by Diana Bomeny." Graduates may not use the Diana Bomeny logo, course titles, course materials, lesson content, scripts, workbooks, or any other proprietary asset in their own teaching, marketing, or client work, and may not train or certify other practitioners using Diana Bomeny content. A separate teacher-training license is required to teach any Diana Bomeny curriculum to others.
RETREATS AND IN-PERSON OFFERINGS
Retreats, workshops, and ceremonies held in Miami, at the healing centre in Mallorca, or elsewhere in the world are subject to the specific participant agreement provided with your confirmation. That agreement covers arrival, departure, accommodation, dietary considerations, health disclosures, liability waivers, photography consent, and conduct expectations.
Travel, visas, insurance, and transportation to and from the retreat location are your responsibility. We strongly recommend travel insurance for all international retreats.
HEALTH AND WELLNESS DISCLAIMER
Diana Bomeny is a yoga teacher, breathwork practitioner, meditation teacher, sound healer, and Internationally Accredited Crystal Healing Therapist. She is not a licensed medical doctor, psychologist, psychiatrist, nutritionist, or mental health professional.
The sacred offerings, content, and communications on this Site are for educational and wellness purposes. They are not a substitute for medical diagnosis, treatment, therapy, or emergency care. Nothing on this Site should be taken as medical, psychological, or legal advice.
Required health disclosure: Before participating in any sacred offering — private sessions, group classes, workshops, breathwork, ceremonies, retreats, or any other in-person or online offering — you are required to disclose any relevant health conditions. This includes, but is not limited to: pregnancy, recent injury or surgery, cardiovascular conditions, respiratory conditions, seizure disorders, chronic illness, mental health diagnoses, history of trauma, and any medications you are taking. Disclosure is made through the booking form, health intake, or directly in writing before your session.
By booking any sacred offering, you confirm that you have disclosed all relevant health information to the best of your knowledge. If you fail to disclose a condition or omit information that is material to your safety or practice, you release Diana Bomeny, her team, and her affiliated entities from any and all liability for harm, injury, or outcome arising from that non-disclosure.
If you are pregnant, recovering from injury or surgery, managing a chronic condition, living with a mental health diagnosis, or taking medication, please also consult your physician or licensed professional before beginning any practice, breathwork, movement, ceremony, or retreat. You are responsible for practising within your own limits and for communicating with your teacher before and during a session.
In a medical or mental health emergency, call your local emergency number. In the United States, call or text 988 for the Suicide and Crisis Lifeline.
INTELLECTUAL PROPERTY
All content on this Site — writing, photography, video, audio, meditations, course materials, course titles, graphics, design, logos, and the name Diana Bomeny — is the property of Diana Bomeny or its licensors, and is protected by copyright, trademark, and related laws. Original mantra music released on streaming platforms remains the intellectual property of its rights holders.
You may use the Site for personal, non-commercial purposes. You may not copy, republish, scrape, train machine-learning models on, or otherwise reproduce any portion of the Site or its content without prior written permission.
Your own reviews, comments, or submissions: by sharing a testimonial, review, or other written or recorded content with us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, excerpt, and display what you have shared across Diana Bomeny's teaching and marketing channels, including the Site, social media, email, and print. Attribution, when used, will appear as your first name and the first letter of your last name (for example, "Sarah M."). You may request attribution to be made fully anonymous or to have your testimonial retired from active use at any time by emailing hello@dianabomeny.com.
PHOTOGRAPHY AND VIDEO CONSENT
Some in-person sacred offerings — group classes, workshops, ceremonies, and retreats — are photographed or filmed for use in Diana Bomeny's teaching, marketing, and content library. Your inclusion in any such imagery is always by consent.
On every booking form or registration, you will be asked to opt in to photography and video. If you do not opt in, you will not be photographed or filmed, and any incidental footage in which you appear will be reframed or removed before use. You may change your consent at any time, for any future offering or for footage not yet published, by emailing hello@dianabomeny.com.
Consent is assumed only for wide-angle footage of a venue or space where individual participants are not identifiable. Private sessions and one-on-one crystal healing are never filmed or photographed without your explicit, separate written consent.
ACCEPTABLE USE
You agree to use the Site and all sacred offerings with respect for the teachers, participants, and spaces involved. You agree not to:
- Share account access, subscription content, or course materials with people who have not purchased them.
- Record, screenshot, or redistribute live classes, retreats, or private sessions without written consent.
- Harass, threaten, or disrupt other participants, teachers, or staff.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Site or its systems.
- Use the Site or the offerings in any way that is unlawful, harmful, or misrepresents your identity.
We may refuse service, remove access, or end a participant's involvement in an offering where conduct falls outside these standards. Refunds in such cases are at our discretion.
TERMINATION
We may suspend or end your access to the Site, your account, a subscription, or a specific sacred offering at our discretion — with or without notice — if you breach these Terms, if a payment fails, if your conduct affects the safety or experience of other participants, or where we are required to do so by law. Where termination is the result of a serious breach by you, refunds are at our discretion. You may also end your use of the Site at any time by closing your account or cancelling your subscription. The sections of these Terms that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law — will continue to apply.
THIRD-PARTY LINKS AND SERVICES
The Site may link to third-party platforms — streaming services for mantra music, scheduling tools, payment processors, course platforms, or partner venues. We do not control these services and are not responsible for their content, terms, or privacy practices. Your use of a third-party service is subject to that service's own terms.
PRIVACY
Your use of the Site is also governed by our Privacy Policy, which explains what information we collect, how we use it, and the choices available to you. Please review the Privacy Policy alongside these Terms.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Diana Bomeny, her team, and her affiliated entities are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of your use of the Site or any sacred offering. Our total liability for any claim connected to a specific offering is limited to the amount you paid for that offering.
Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or consumer rights that cannot be waived.
INDEMNIFICATION
You agree to indemnify and hold Diana Bomeny, her team, and her affiliated entities harmless from any claims, losses, liabilities, damages, and reasonable costs (including attorney's fees) arising out of or related to your use of the Site, your participation in any sacred offering, content you submit, or your breach of these Terms. We will notify you promptly of any such claim and may, at our option, manage the defense of any matter to which this section applies.
ASSUMPTION OF RISK
Yoga, breathwork, movement practices, ceremony, sound healing, and travel to retreat locations carry inherent physical and emotional risk. By participating, you acknowledge these risks, confirm that you are physically and emotionally able to participate, and agree to take responsibility for your own wellbeing. Where a specific offering requires a signed waiver, participation is conditional on that waiver.
CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when the most recent version took effect. Material changes will be announced on the Site or by email where appropriate. Continued use of the Site after changes take effect means you accept the updated Terms.
DISPUTE RESOLUTION
If any dispute or concern arises from these Terms, a sacred offering, or your use of the Site, we ask that you contact us first, in writing, at hello@dianabomeny.com. We will acknowledge your message promptly and work with you in good faith to resolve the matter. Both parties agree to engage in good-faith written discussion for at least 30 days before either party files a legal claim. Many concerns can be resolved at this stage, and this step is a required precondition to any court action unless applicable law permits otherwise.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.
For sacred offerings held at the healing centre in Mallorca, Spanish law applies to matters arising at the property, in addition to these Terms.
